Terms and Conditions
Your access to and use of the Site and the products we offer on the Site, is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access the Site or purchase the products of De Diary Sdn Bhd. By accessing or using the Site or purchasing products offered on the Site, you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Site.
Communications:
By creating an Account on our website, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.
Rule and Regulation:
Rule and Regulation are implemented with the purpose of safeguarding the rights and regulating the obligations of De Diary members/ distributor rather than restraining your independent business activities. In order to mould yourself to be a responsible and ethical Member, you must understand and abide by the Rule and regulation, which have the objective of building a healthy business networking environment for your long term and profitable business; promoting unity and positive harmony among fellow Members/ Distributor ; and between Members/ Distributor and De Diary Sdn. Bhd. Your strength and success as a Member/ Distributor is a collective effort, founded upon the enduring partnership of commitment and trust that exists between the Company and our Members.
It is the responsibility of each Member/ Distributor to;
- Read, understand, adhere to and ensure that he/ she is aware of and operating under the most current version of the Rule and Regulation.
- Update their contact details and correspondence/e-mail addresses and contact details as captured in its database.
- Member/ Distributor will not resort to any fraudulent act in promoting the Company’s business at the expense of the Company, fellow Members and to the e-commerce industry.
- Member/Distributor will not make negative or disparaging remarks about the Company, its employees, officers, directors or denigrate other company’s products, marketing plan or any other features of another company. We will be respectful to the Company and to the e-commerce industry as a whole.
- Member/ Distributor will not use the Company’s trade name(s), information, literature, advertising materials and Company’s resources for any other business interests or purpose not authorized by the Company.
- All products of the Company shall be marketed and sold in its original form and packaging. Member/ Distributor shall not alter, relabel, repackage, rebundle, unbundle, sell in loose form, or otherwise change any of the Company’s products or sell any product under any name or label other than that authorised by the Company.
- Member/ Distributor shall not allow to participating and displaying Company’s products at trade shows/conventions or any other e-commerce platforms.
Returns and Refund Policy:
We do not accept refund for the products, but we are happy to provide exchange if the product is damaged. We try very best packaging all items to reduce the occurrence of damage, occasionally accidents happen during shipment. If your order arrived damaged or defective, we are happy to replace the damaged/defective items in your order under the 3 Days Returns Policy.
Your order number. – The details of the damaged/defective product received. – Attach product images of damaged/defective products upon receipt. We will respond to your message as quickly as we can. In the meantime, please DO NOT throw away your damaged items or send them back without our approval. We will ask you to send the damaged items back to us after exchange request is approved.
The returns products are excluded : – Any product returned more than 10 days after receipt date – Opened, damaged, used, in-completed (except after spoilage discovered/ broken package) – No longer in its original saleable condition – Any non-refundable free gifts/ samples/ trial packs – We will process your returns within 10 working days after receiving the returned parcel. You are responsible to take good care of the items before you return them to us.
However, this returns products policy only applies to products that were purchased through Company’s official website and/or from Members/ Distributor. Expired products or damaged products due to negligence, misuse, unintended use, mishandling or unauthorized modification are not accepted.
Products without official receipt – Any products that are not from De Diary Sdn. Bhd. Should the items be satisfied all above conditions, please contact us and we will follow up and process your requirement immediately.
When you receive your good, please check to make sure they in good condition (i.e. not damaged or defective) and contact us right away if there is a problem with your shipment.
Purchases:
If you wish to purchase any product made available through the Site (“Order”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information. You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete. The website may employ the use of third party services for the purpose of facilitating payment and the completion of Purchases. By submitting your information, you grant us the right to provide the information to these third parties subject to our Privacy Policy. We reserve the right to refuse or cancel your order at any time for reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons. We reserve the right to refuse or cancel your order if fraud or an unauthorized or illegal transaction is suspected.
Contests, Sweepstakes and Promotions:
Any contests, sweepstakes or other promotions (collectively, “Promotions”) made available through the Site may be governed by rules that are separate from these Terms & Conditions. If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy. If the rules for a Promotion conflict with these Terms and Conditions, the Promotion rules will apply.
- All products of the Company shall be sold at the price prescribed or approved by the Company. No Member/Distributor is allowed to raise or lower the price of any products. Pricing
- Members/ Distributor shall sell products to customers at Consumer Retail Price. Only Members/ Distributor can enjoy the Company’s products at the Member Price/ Distributor Price and those offered as the Company’s official promotional packages.
- Members/ Distributor shall not under-price or over-price any product of the Company for the purposes of gaining higher profits or promoting sales. This action may warrant termination and/or legal action against the violators by the Company.
- Under-pricing or over-pricing in the above context means:
- All products of the Company shall be sold at the price prescribed or approved by the Company. No Member/Distributor is allowed to raise or lower the price of any products.
- No Member/ Distributor is allowed to carry out their own promotion unless with prior written approval from the Company.
- Products obtained during promotions or with purchase offers shall be sold at the price prescribed or approved by the Company.
- Member/ Distributor is not allowed to resell the Company’s products to other groups or others distributor.
Accounts:
When you create an account with us, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Site. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Site or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.
Effects of Suspension and Termination
- A Member may choose to suspend his/her membership with written notice to the Company. In doing so, the membership will not expired.
- A Distributor may choose to suspend his/her distributor partnership with written notice to the Company. In doing so, distributor partnership will expires (2 years from last purchase).
